Stronger Together: Nonprofit Combinations for a More Resilient Industry
with Jacob Ferrari with The Apex Law Group PLLC
This presentation focuses on the topic of nonprofit mergers, consolidations, affiliations, asset transfers, and other forms of organizational combinations.
The statistics currently show that with the current demand for nonprofit funding and the current dearth of options for such funding, nonprofits are finding themselves at a crossroads. In short, there are simply too many nonprofits competing for the same spring of nonprofit funding. I advocate for and assist with nonprofit mergers in my current practice. I help address the legal issues and risks associated with nonprofit combinations and help shepherd organizations through transitionary seasons in order to combine resources for more efficient work.
Nonprofit mergers should not be looked at as last resorts or as institutional failures. But rather strategic solutions and options for organizational viability. While nonprofits often look at merger as a defining trait of missional failure, for-profit organizations often look to mergers and acquisitions as an end goal and mark of success. The mindset in the nonprofit space should flip.
The audience will be walked through strategic considerations, legal risk assessments, and practical steps on how a nonprofit merger/consolidation/acquisition works.
